1. Agreement to Terms

By accessing or using Hammer for Mac ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

2. Description of Service

Hammer for Mac is a static site generator application for macOS. The Service allows you to build and generate static websites using HTML, CSS, and JavaScript with additional templating features.

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with these Terms and all applicable local, national, and international laws and regulations

4. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding any credentials used to access the Service and for any activities that occur under your account.

You agree not to share your account credentials with any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.

You retain ownership of any content you create using the Service. By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, display, and perform your content solely for the purpose of providing and improving the Service.

7. License to Use Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or commercial purposes.

8. Prohibited Uses

You may not:

  • Copy, modify, distribute, sell, or lease any part of the Service
  • Reverse engineer or attempt to extract the source code of the Service
  • Use the Service to build a competitive product or service
  • Remove, alter, or obscure any proprietary notices on the Service

9. Payment Terms

If you purchase any paid features or subscriptions, you agree to pay all applicable fees. All fees are in the currency specified at the time of purchase. Fees are non-refundable except as required by law or as otherwise specified.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. You may also terminate your account at any time by contacting us.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or free from errors, viruses, or other harmful components.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
